文物保护法视野下的文物建筑保护与开发研究*

Research on Conservation and Development of Cultural Relic Buildings in China in the perspective of Law of the People’s Republic of China on the Protection of Cultural Relics*

摘要:

基于“荫余堂”迁建美国、成龙海外捐赠徽派古建筑等典型案件，对相关案例所涉法律问题予以剖析并系统梳理我国古建筑保护中的法规疏漏及实践盲点，通过比较、借鉴域外古建筑保护与开发相关制度化举措，进一步明确保护主体及职责、保护范围与开发限度，倡导遗产保护与城镇化建设协调发展，促进遗产保护公众参与机制。

Abstract:

Based on the deep analysis of the legal issues of the cases, Yin Yu Tang relocation to the United States and Jackie Chan donated Huizhou architecture to Singapore, the paper systematically elaborates the legal loopholes and practical blind spots in the protection of ancient buildings in China at first. And then, through comparing and drawing on the successful institutionalized measures of other countries, the article further clarifies the subject of protection and their responsibilities as well as the scope of protection and the limit of development, emphasizes the coordination of heritage protection and urbanization construction and promoting public participation mechanisms in cultural heritage protection.
